Terms and Conditions for Use and Disclosure of Media and Information (Australia)

These Terms and Conditions outline how Scenic Training (“we”, “us”, or “our”) may use, store, and disclose photos, video recordings, audio clips (voice), and other personal information (“Media and Information”) provided to us by clients (“you”).
1. Consent to Use and Disclosure
By providing us with any Media and Information, you grant us express consent to:
• Use the material for the purposes agreed upon at the time of collection (e.g., marketing, promotional material, testimonials, case studies).
• Edit, reproduce, publish, and distribute the material in any medium including online platforms, social media, or printed publications.
• Disclose it to third parties where necessary for the stated purposes (e.g., web developers, marketing agencies), and in compliance with Australian law.
2. Personal Information and Privacy
We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
We will:
• Collect only necessary personal information.
• Use and disclose personal information solely for the purpose it was provided or as otherwise permitted under the Privacy Act.
• Take reasonable steps to ensure the information is accurate, up to date, and secure.
• Allow you to access and correct your personal information upon request.
3. Copyright and Intellectual Property
Unless agreed otherwise in writing:
• You retain copyright over your original materials (e.g., your image, voice).
• You grant us a non-exclusive, royalty-free, worldwide licence to use the Media and Information for the stated purposes.
• We will not sell or license your content to third parties without your consent.
4. Withdrawal of Consent
You may withdraw consent at any time by contacting us in writing.
Upon withdrawal:
• We will cease further use or disclosure.
• Previously published material may remain in circulation and online (e.g., printed materials or posts already published) but we will take reasonable steps to remove or stop using it moving forward.
5. Storage and Security
We will store your information securely, in either electronic or physical formats.
Reasonable steps are taken to protect your Media and Information from:
• Misuse, interference, or loss;
• Unauthorised access, modification, or disclosure.
6. Voice and Audio Recordings
We comply with relevant state/territory laws regarding audio recordings.
• If you are in a state that requires all-party consent (e.g., NSW, SA), we will always obtain your written or verbal consent before making any recordings.
